Terms of Service

1. Acceptance

By creating an account on Elements Engage, you agree to these Terms and to our Privacy Policy. If you're signing up on behalf of an organisation, you confirm you're authorised to bind that organisation.

2. Your account

You're responsible for keeping your credentials confidential and for everything that happens under your account. Notify us immediately at security@elementsmarketing.ie if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms or appear to be compromised.

3. Acceptable use

You agree not to:

  • Share login credentials or let non-members access the Platform via your account.
  • Scrape, reverse-engineer, or bulk-download content beyond the product's UI.
  • Redistribute Platform content outside your organisation without permission.
  • Attempt to disrupt, probe, or circumvent security or authentication controls.
  • Upload content that is unlawful, infringing, harassing, or malware.

4. Content and downloads

Content in the library is licensed to you for internal use within your organisation. Public-facing redistribution requires written permission. Download links are per-session and must not be shared outside the Platform — shared links will not work without a valid signed-in session.

5. Subscription and billing

Paid plans renew on their anniversary unless cancelled. Refunds are issued pro-rata at our discretion for technical failures on our side.

6. Termination

Either of us can terminate at any time. On termination, you can export your data via the account page. We retain anonymised records for up to 24 months.

7. Warranties and liability

The Platform is provided "as is". We don't guarantee uninterrupted service. To the maximum extent permitted by law, our aggregate liability in any 12-month period is capped at the fees you paid us in that period.

8. Governing law

These Terms are governed by the laws of Ireland. Disputes go to the courts of Ireland, subject to any mandatory consumer protections available to you locally.

9. Changes

We'll let you know in-app before material changes and give you a chance to object. Continuing to use the Platform after the effective date constitutes acceptance.
